Terms and Conditions

1. About the seller

Unbreakable Spirit Shop is operated from Queensland, Australia. References in these Terms to "Unbreakable Spirit", "the Shop", "seller", "we", "us" or "our" are references to the business operating the Unbreakable Spirit Shop.

2. Products and availability

  • Products sold through the Unbreakable Spirit Shop are merchandise items.

  • Some or all products may be offered on a pre-order basis.

  • A pre-order means the item is purchased before stock is available for immediate dispatch.

  • Product images are for general illustration only. Colours, print placement and minor finishing details may vary slightly from what appears on a screen.

  • Sizing charts and product descriptions are provided as a guide only. Customers are responsible for reviewing product details before placing an order.

3. Pre-orders

  • Where an item is marked as a pre-order, the customer acknowledges that production and dispatch will occur after the order is placed.

  • Any estimated dispatch or delivery date is an estimate only and may change due to manufacturing delays, supplier delays, shipping disruptions, customs processing, or events outside our reasonable control.

  • If there is a substantial delay, we will aim to notify the customer using the contact details provided with the order.

  • If we are unable to supply a pre-order item within a reasonable time, or at all, we may offer a refund, store credit, or another reasonable solution in line with Australian Consumer Law.

  • Where an order includes both pre-order and in-stock items, we may ship the items together once the pre-order stock is available, unless we state otherwise.

4. Orders

  • All orders are subject to acceptance and availability.

  • We may decline or cancel an order where there has been a genuine error in pricing, product description, stock availability, suspected fraud, or where the order breaches these Terms.

  • If payment has already been processed for a cancelled order, we will refund the amount paid using the original payment method unless otherwise agreed.

  • Customers must ensure their order details, including delivery address, email address, product selection and sizing, are correct at the time of purchase.

5. Pricing and payment

  • All prices are listed in Australian dollars (AUD) unless stated otherwise.

  • Prices may include or exclude shipping and any applicable taxes as stated at checkout.

  • Full payment is required at the time a pre-order or standard order is placed unless otherwise stated.

  • We may change pricing at any time before an order is submitted.

6. Shipping and delivery

  • Delivery timeframes are estimates only and are not guaranteed.

  • Risk in the goods passes to the customer on delivery to the nominated address, to the extent permitted by law.

  • Title to the goods remains with us until full payment has been received.

  • Customers are responsible for ensuring that the delivery address is accurate and that someone is available to receive the parcel where required.

  • We are not responsible for delays caused by postal carriers, couriers, customs, or events outside our reasonable control.

7. Returns, refunds and exchanges

Nothing in these Terms excludes, restricts or modifies any rights a customer may have under the Australian Consumer Law.

7.1 Consumer guarantee rights

If a product fails to meet a consumer guarantee under the Australian Consumer Law, the customer may be entitled to a repair, replacement, refund or other remedy depending on whether the problem is major or minor.

Examples include where the item:

  • is faulty,

  • is not of acceptable quality,

  • does not match its description,

  • does not match a sample or demonstration model, or

  • is not fit for a purpose made known to us.

Where required by law, we will also cover return postage or other reasonable costs associated with a valid consumer guarantee claim.

7.2 Change of mind

  • We do not offer refunds for change of mind on pre-order items, including where the customer changes their preference, selects the wrong size, enters an incorrect address, or no longer wants the item after ordering.

  • For non-pre-order items, any change-of-mind return or exchange is only available if we expressly offer it on the product page or in a separate store policy.

  • Change-of-mind rights under this clause do not apply where the customer has rights under the Australian Consumer Law.

7.3 Return conditions for eligible non-faulty items

If we approve a return or exchange for a non-faulty item as a matter of store policy, the item must usually:

  • be unused and unwashed,

  • be in original condition with tags or original packaging where applicable,

  • be returned within the timeframe stated in the applicable store policy, and

  • be accompanied by proof of purchase.

For approved non-faulty returns, the customer is responsible for return shipping unless we state otherwise.

7.4 Damaged, faulty or incorrect items

  • Customers should inspect their order as soon as reasonably possible after delivery.

  • If an item arrives damaged, faulty or incorrect, the customer should contact us promptly with their order number, a description of the issue, and clear photos where relevant.

  • We may ask for further information to assess the claim before providing a remedy.

7.5 Non-returnable items

To the extent permitted by law, we may refuse returns for:

  • items that have been worn, washed, altered or damaged after delivery,

  • items returned without proof of purchase,

  • personal care or hygiene-sensitive items where return is not appropriate for health or safety reasons after opening, and

  • any item excluded from change-of-mind returns because it is a pre-order, custom, personalised or final sale item, unless the item does not comply with the Australian Consumer Law.

8. Cancellations

  • Pre-order purchases cannot be cancelled for change of mind once the order has been placed, unless required by law.

  • If a customer requests cancellation before production or fulfilment begins, we may consider the request at our discretion, but we are not required to approve it.

  • If we cancel an order because we cannot supply the item, we will provide a refund or another suitable remedy.

9. Promotional offers

  • Promotional codes and special offers must be used in accordance with their stated terms.

  • Promotions may be withdrawn or changed at any time before checkout is completed.

  • Unless required by law, promotions cannot be applied retrospectively to completed orders.

10. Intellectual property

All content on the Unbreakable Spirit Shop, including logos, branding, graphics, product names, images, text and designs, remains the property of Unbreakable Spirit or its licensors and must not be copied, reproduced or used without permission.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from use of the Shop or purchase of goods. Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

12. Privacy

We may collect and use personal information to process orders, deliver products, communicate about purchases, and manage customer service. Personal information will be handled in accordance with any applicable privacy policy published by the business and applicable privacy laws.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. Any disputes relating to these Terms or the sale of products will be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia, unless applicable law provides otherwise.

Returns and refunds

Unbreakable Spirit complies with the Australian Consumer Law. If an item is faulty, not of acceptable quality, not fit for purpose, or does not match its description, you may be entitled to a repair, replacement or refund.
We do not offer change-of-mind refunds on pre-order items. For approved non-faulty returns (if offered), items must be unused, in original condition, and returned with proof of purchase in accordance with our store policy.
